1. Value: This gift certificate, which is either valued at $600 (10 images), $900 (25 digital images) or $1100 (35 digital images and 1 10 x 8 art print) corresponds to a gift package including a set no of digital images and session fee.
2. Expiry :The gift certificate is valid for 3 years from the date of purchase, in accordance with Australian Consumer Law. The photography session must be booked before the expiry date.
3. Booking Subject to Availability: Sessions are subject to photographer availability. While every effort will be made to accommodate preferred dates, availability cannot be guaranteed.
4. Additional Purchases: Additional edited digital images, prints and wall art are available for purchase at current pricing. As at 2026, additional digital images are $30 each. Prices are subject to change.
5. Image Selection Timeframe: Clients are requested to select their included images within 30 days of receiving their online gallery. Galleries may be archived after this period and retrieval may incur an administration fee.
6. Photographer Usage: Unless the recipient advises otherwise before the session, Bluebird Photography may use selected images for its portfolio, website and social media. Bluebird Photography will always respect a client’s privacy request.
7. Unedited Images: RAW and unedited images are not included and will not be supplied.
8. Editing Style: Clients acknowledge they have viewed Bluebird Photography’s portfolio and are booking based on the photographer’s editing style. Bluebird Photography applies natural, professional editing to produce flattering, true-to-life images while maintaining a fair likeness of each person. This includes adjustments such as exposure, colour, contrast and minor skin retouching where appropriate. Requests for extensive retouching or digital alterations, including significant changes to body shape, facial features, or other physical characteristics, are outside Bluebird Photography’s standard editing style and may be declined or incur an additional fee.
9. Lost Gift Certificate:If lost, please contact Bluebird Photography. Replacement may be issued where proof of purchase can be verified and the gift certificate has not already been redeemed.
10. Acceptance of Terms & Conditions: By purchasing or redeeming this gift certificate, you acknowledge that you have read and agree to these Terms & Conditions. Where a gift certificate is purchased on behalf of another person, it is the purchaser’s responsibility to provide the recipient with a copy of these Terms & Conditions. By booking or attending a photography session using the gift certificate, the recipient acknowledges that they have read, understood and agree to be bound by these Terms & Conditions.
11. Cancellations, Rescheduling & No Shows: If you need to reschedule your session, please contact Bluebird Photography as soon as possible. Every effort will be made to accommodate an alternative date, subject to availability. If Bluebird Photography receives less than 48 hours’ notice that you are unable to attend your booked session, or you do not attend your scheduled session, $200 of the gift certificate value will be deemed redeemed to cover the reserved studio time, preparation and associated business costs. The remaining $400 credit may be used towards one replacement studio session, provided the new session is booked within the gift certificate’s validity period. If the current session price exceeds the remaining credit, the difference must be paid before the replacement session. Gift certificate values, including any remaining credit, are not redeemable for cash and are non-refundable except where required by Australian Consumer Law.
12. Copyright & Personal Use Licence: Unless otherwise agreed in writing, copyright in all photographs remains the property of Bluebird Photography in accordance with the Copyright Act 1968 (Cth). Upon full payment, the client is granted a non-exclusive, non-transferable, perpetual licence to use the delivered images for personal, non-commercial purposes only. This includes displaying, sharing with family and friends, and printing the images for personal enjoyment.
The client must not, without the prior written consent of Bluebird Photography
- Sell, licence or otherwise commercially exploit the images;
- Transfer or assign the licence to another person or organisation,
- Submit the images to competitions or publications that require the entrant to own the copyright or grant commercial usage rights they do not hold;
- Use the images for advertising, marketing or any business or commercial purpose; edit, alter or apply filters to, transfer or make AI-generated modifications to the delivered images;
Nothing in these Terms & Conditions limits any rights the client may have under the Australian Consumer Law.
13. Liability: To the extent permitted by law, Bluebird Photography is not liable for any loss, damage or personal injury arising from the photography session, except where such liability cannot be excluded under Australian Consumer Law or any other applicable legislation.
14. Image archival period :Bluebird Photography will retain delivered images for a minimum of six (6) months after delivery. Clients are responsible for downloading and backing up their images upon receipt. While reasonable care is taken to store image files, Bluebird Photography cannot guarantee indefinite archiving and accepts no responsibility for images lost after the archival period.
15. Studio sessions are by appointment only. The studio address will be provided once a booking has been confirmed. Bluebird Photography primarily offers outdoor photography sessions. Where a studio session has been arranged, the studio address will be provided approximately 2 days prior to your booking along with your session confirmation and any final preparation details. Clients are requested not to attend the property without a confirmed appointment.
